User Agreement & Privacy Policy

By creating an account, accessing, or using this application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Service. Continued use of the Service after any update to these Terms constitutes your acceptance of the revised Terms.

You must be at least 13 years of age to create an account. Users between the ages of 13 and 17 represent that they have obtained parental or guardian consent to use the Service and agree to these Terms. Children under 13 may only use the Service through a Parent account managed by a parent or legal guardian. The parent or guardian accepts these Terms on behalf of the child and is responsible for all use of the Service under that account. By creating an account, you affirm that you are 13 years of age or older and that all information you provide is accurate. Parents wishing to provide access for a child under 13 must do so through a Parent account by selecting the Parent role at signup; the parent or guardian is responsible for the child's use of the Service. We reserve the right to terminate any account that we reasonably believe is held by a user who does not meet these requirements.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to: • Provide accurate, current, and complete information during registration • Promptly update your account information if it changes • Notify us immediately at support@fencingvault.app of any unauthorized access or suspected breach of your account • Not share your password or account access with any third party • Not create more than one account per person without our prior written consent This application is not liable for any loss or damage arising from unauthorized access to your account resulting from your failure to safeguard your credentials. We reserve the right to disable or terminate any account at any time for any reason, including if we believe your account information is inaccurate or that you have violated these Terms.

Subject to your compliance with these Terms, this application grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to: • Sublicense, sell, resell, transfer, assign, or commercially exploit the Service • Reproduce, duplicate, copy, or create derivative works based on the Service • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service • Use any automated scraping, crawling, or data extraction tools on the Service • Frame or mirror any part of the Service without our prior written consent All rights not expressly granted in these Terms are reserved by this application.

You retain ownership of all video content, notes, and other materials you upload to the Service ("Your Content"). By uploading or submitting Your Content, you grant this application a worldwide, non-exclusive, royalty-free, sublicensable license to store, host, process, display, and transmit Your Content solely as necessary to provide and operate the Service. This license is limited strictly to delivering the Service to you. We do not claim ownership of Your Content, will not submit Your Content to any AI provider for model training, will not share it with third parties except as described in our Privacy Policy, and will not display it to other users without your explicit action. You represent and warrant that: • You own or have the necessary rights to Your Content and to grant this license • Your Content does not infringe any third-party intellectual property, privacy, publicity, or other rights • Your Content complies with all applicable laws and these Terms • You have obtained the consent of any identifiable individuals depicted in Your Content, or are authorized to upload footage of them (e.g., as a parent, coach, or club administrator with appropriate authorization) This application respects the intellectual property rights of others and expects users to do the same. All trademarks, service marks, logos, and other brand features of this application are the exclusive property of this application and may not be used without prior written permission.

You agree not to use the Service to upload, post, transmit, or share any content or to engage in any conduct that: • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy • Depicts or promotes child sexual abuse material (CSAM) or exploitation of minors in any form • Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights • Contains unauthorized advertising, spam, chain letters, or pyramid schemes • Introduces viruses, malware, or other malicious code • Attempts to gain unauthorized access to any portion of the Service, other accounts, or third-party systems • Impersonates any person, entity, or organization • Violates the privacy of any individual, including unauthorized collection or sharing of personal information • Depicts or encourages violence, harassment, or illegal activity You also agree not to: • Use the Service for any commercial purpose or for any public display without our written consent • Interfere with or disrupt the integrity or performance of the Service • Attempt to probe, scan, or test the vulnerability of the Service without authorization • Use the Service to compete with or build a similar service We reserve the right, but have no obligation, to monitor Your Content and to remove or disable access to any content that violates these Terms, at our sole discretion and without notice.

This application is a community platform that enables users to upload fencing videos, exchange coach messages, and share content with club members. We take the safety and integrity of that community seriously. What constitutes reportable content You may report any message or content that you believe violates these Terms, including but not limited to: • Spam or unsolicited commercial messages • Harassment, threats, or targeted abuse directed at any individual • Inappropriate, offensive, or sexually explicit material • Impersonation of another person or organization • Any content that depicts or promotes illegal activity How to report in the app To report a message, press and hold (long-press) the message in your Messages inbox. You will be prompted to select a reason for the report: • Spam • Harassment • Inappropriate content Your report is submitted immediately and confidentially to our moderation team. You will receive an on-screen confirmation that your report has been received. How we handle reports All reports are reviewed by our moderation team, typically within 72 hours. Upon review, we may take one or more of the following actions: • Remove or hide the reported content • Issue a warning to the offending account • Temporarily suspend the offending account • Permanently terminate the offending account and report to law enforcement where required by law We will not disclose the outcome of moderation actions to the reporting user except as required by applicable law. Submitting a false or malicious report in bad faith may itself be a violation of these Terms. No guarantee of content review While we are committed to maintaining a safe platform, this application does not pre-screen user-generated content prior to publication. We are not liable for any content uploaded by users. If you encounter content that you believe is unlawful or harmful, please use the in-app reporting tool or contact us directly at support@fencingvault.app. Repeat infringers In accordance with applicable law and platform policy, this application will terminate the accounts of users who are determined to be repeat infringers of these content standards.

This application uses artificial intelligence (AI) in one specific feature: AI Bout Quick Prep. This is the only feature within the Service that uses AI technology. No other features of this application use AI to process, analyze, or generate content. What AI Quick Prep does: When you use the AI Bout Quick Prep feature, your fencer notes and relevant bout information are sent to a third-party AI provider for processing. The AI generates a preparation summary designed to help you prepare for an upcoming bout. The output is generated by an automated AI system, not a human coach or analyst. AI-generated content is not professional advice: Output from the AI Quick Prep feature is for informational and preparation purposes only. It does not constitute professional coaching advice, sports psychology guidance, or medical advice. You should use your own judgment in evaluating any AI-generated content. Data sent to the AI provider: Only the notes and bout information you submit through the AI Quick Prep interface are sent to our AI provider. Your videos, private fencer notes stored elsewhere in the app, account information, and other vault content are not sent to the AI provider. No training by default: Our AI provider (Anthropic) does not use API data to train their models by default under their standard API terms. We do not separately submit AI Quick Prep data to any AI provider for model training. AI availability: The AI Quick Prep feature is available to eligible membership tiers only. Availability and usage limits are subject to change. We reserve the right to modify, limit, or discontinue the AI Quick Prep feature at any time. Accuracy and limitations: AI-generated content may contain errors, omissions, or inaccuracies. This application makes no representations or warranties regarding the accuracy, completeness, or fitness for any purpose of AI-generated output. You use the AI Quick Prep feature at your own risk.

The Service includes features that allow you to share videos with club members and coaches and receive coaching feedback. Club Vault Sharing: When you share a video to your club's vault, that video becomes visible to all verified members of your club, including coaches and other fencers. You should only share content you are comfortable having all club members view. You can remove a shared video from the club vault at any time. Club Coach Notes: Notes left by your club coach on your video are visible to both the coach who authored them and you as the video uploader. They are not visible to other club members. Coach Notes: Notes and feedback provided through coaching features are for informational purposes only. This application makes no representations about the accuracy of any coaching notes or feedback.

The Service allows a Parent account and a Fencer account to be linked so that bouts recorded by either party are visible to both. This is intended for parents, guardians, or trusted family members who help record their fencer's bouts at tournaments. How a link is established: One party generates a six-character invite code from within the app. The code expires automatically after ten minutes. The other party enters the code to complete the link. No link is created without action from both parties. Scope of sharing: A link is bound to a specific USA Fencing Name selected by the fencer at the time the link is created. Only Cloud Vault bouts associated with that USA Fencing Name are shared between the linked accounts. Bouts recorded under a different USA Fencing Name, private fencer notes, account information, and other vault content are not shared. Direction of sharing: Bouts recorded on the parent's device sync to the fencer's account, and bouts recorded on the fencer's device are visible to the parent. Either party may upload, view, and download shared bouts. Revoking a link: Either party can revoke the link at any time from within the app. Once revoked, no further bouts will be shared between the accounts. Bouts that were already shared before revocation remain on each account's vault and can be deleted individually by the account that owns them. Multiple links: A Parent account may link to more than one Fencer account (e.g., siblings), and a Fencer account may link to more than one Parent account (e.g., two parents). Each link is independently established and independently revocable.

This application respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Service infringes your copyright, please send a written notice to our designated DMCA agent at dmca@fencingvault.app containing: 1. Your physical or electronic signature (or that of a person authorized to act on your behalf) 2. Identification of the copyrighted work you claim has been infringed 3. Identification of the allegedly infringing material and information sufficient for us to locate it (e.g., a URL or video ID) 4. Your contact information: name, address, telephone number, and email address 5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law 6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Users who repeatedly infringe third-party copyrights may have their accounts terminated. If you believe your content was wrongly removed, you may submit a counter-notification to dmca@fencingvault.app.

This application offers free and paid membership tiers. Paid memberships are available on a recurring subscription basis. Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) at the then-current subscription price unless you cancel before the renewal date. Billing: For subscriptions purchased through the Apple App Store or Google Play Store, billing is handled by the respective platform and is subject to their terms. For direct subscriptions, your payment method will be charged on the renewal date. Price Changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice before a price change takes effect. Continued use of the Service after a price change constitutes your acceptance of the new price. Cancellation: You may cancel your subscription at any time through your account settings or the platform through which you subscribed. Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until the end of the period for which you have paid. Free Trials: If we offer a free trial, you must cancel before the trial ends to avoid being charged. We will clearly disclose the trial terms and the date on which billing begins at the time you start the trial.

All membership purchases made through the Apple App Store or Google Play Store are governed by and subject to the refund policies of those respective platforms. Please contact Apple or Google directly to request a refund for purchases made through their stores. For memberships purchased directly from this application, please contact support@fencingvault.app with your registered email address and the subject line "Refund Request."

You may close your account at any time through Settings → Delete Account in the app, or by following the instructions at fencingvault.app/delete-account.html (also accepts requests from users who have uninstalled the app). This application reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to: • Violation of these Terms or our Privacy Policy • Repeated copyright infringement • Conduct that is harmful, abusive, or illegal • Extended inactivity (accounts inactive for more than 24 consecutive months) • Fraudulent, deceptive, or unauthorized use of the Service Upon termination: • Your license to use the Service immediately ends • Access to videos and other vault content stored on our servers ends at the close of your current membership period • Uploaded videos and associated data may be permanently deleted from our servers following the close of your membership period; we do not provide a separate export or bulk-download service, so we recommend keeping your own copies of any video you wish to retain • For terminations due to Terms violations, deletion may occur sooner at our discretion • Provisions of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitation of liability) will survive This application will not be liable to you or any third party for termination of your account or access to the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS APPLICATION EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING COACHING NOTES OR FEEDBACK • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law. Your use of the Service is at your sole risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THIS APPLICATION, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY: • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL • LOSS OF UPLOADED CONTENT OR INABILITY TO ACCESS YOUR ACCOUNT • COST OF SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THIS APPLICATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO THIS APPLICATION IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless this application, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: • Your use of or access to the Service • Your Content, including any claim that Your Content infringes a third party's intellectual property, privacy, or other rights • Your violation of these Terms • Your violation of any applicable law or the rights of any third party • Any claim arising from footage you upload that depicts another person without proper authorization This application reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Informal Resolution: Before initiating any formal legal proceeding, you agree to first contact us at legal@fencingvault.app and provide a written description of the dispute, the relief you are seeking, and your contact information. We will attempt to resolve the dispute informally within 30 days. Binding Arbitration: If we cannot resolve the dispute informally, you and this application agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as provided below. The arbitration will be conducted in the State of New Jersey or, at your election, by telephone or video conference. CLASS ACTION WAIVER: YOU AND THIS APPLICATION EACH AGREE THAT ANY PROCEEDING, WHETHER IN ARBITRATION OR IN COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF A COURT OR ARBITRATOR DETERMINES THAT THE CLASS ACTION WAIVER IS UNENFORCEABLE, THEN THE ARBITRATION PROVISION SHALL BE NULL AND VOID. Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. Claims for amounts under $500 may be brought in small claims court. You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to legal@fencingvault.app with the subject line "Arbitration Opt-Out" and your name and account email address.

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. For any disputes not subject to arbitration under these Terms, or if the arbitration provision is found unenforceable, you and this application irrevocably consent to the exclusive jurisdiction of the state and federal courts located in New Jersey, USA, and you waive any objection to the laying of venue in those courts.

We reserve the right to modify these Terms at any time. When we make material changes, we will: • Update the "Last Updated" date at the top of these Terms • Notify you via email or an in-app notification at least 14 days before material changes take effect • For changes that significantly affect your rights, request your renewed acceptance where required by law If you do not agree with the revised Terms, you must stop using the Service before the changes take effect. Continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. We may make non-material changes (such as correcting typographical errors or clarifying existing provisions) without notice.

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and this application regarding the Service and supersede all prior agreements and understandings. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver will only be effective if made in writing and signed by an authorized representative of this application. Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. This application may assign its rights and obligations under these Terms without restriction. Force Majeure: This application will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, government actions, internet outages, or other events outside our control. Notices: Notices to this application should be sent to legal@fencingvault.app. We may send notices to you via the email address associated with your account or via in-app notification. Section Headings: Section headings are for convenience only and have no legal or contractual effect.
